These Terms of Service constitute a legally binding agreement between you and Infolyxo regarding your use of our website and services. By accessing or using our services, you agree to be bound by these Terms.
Description of Services
Infolyxo provides property preparation coordination services for owners entering the short-term rental market in Chile. Our services include coordination of cleaning, repairs, furnishing, decoration, photography, and listing content creation. We do not provide ongoing property management or reservation handling services.
Service Scope
Our services are limited to preparing properties for initial entry into the short-term rental market. Once preparation is complete and your property is ready for listing, our service engagement concludes. Any ongoing operational needs are your responsibility or may be addressed through separate property management arrangements.
Service Engagement Process
Service engagement follows this general process:
- Initial consultation and property assessment
- Preparation plan and cost estimate development
- Service agreement execution
- Preparation work coordination and completion
- Final walkthrough and documentation delivery
Service Agreements
Specific terms for each property preparation project are documented in individual service agreements. Those agreements supplement these general Terms of Service and govern the specific services provided for your property.
Fees and Payment
Service fees are determined based on property-specific requirements and documented in service agreements. Payment terms are specified in individual service agreements.
Estimates
Cost estimates provided during the assessment phase are approximations based on visible conditions and stated requirements. Actual costs may vary if additional issues are discovered during preparation work or if project scope changes.
Client Responsibilities
As a client, you are responsible for:
- Providing accurate information about your property and preparation needs
- Ensuring legal authorization to engage preparation services for the property
- Providing access to the property as needed for assessment and preparation work
- Making timely decisions regarding preparation options and scope
- Ensuring compliance with applicable regulations for short-term rental operations
- Reviewing and approving work at project milestones
Our Responsibilities
Infolyxo commits to:
- Coordinating preparation services in a professional manner
- Providing reasonable estimates of costs and timelines
- Communicating regularly about project progress
- Coordinating with qualified service providers for preparation work
- Delivering services substantially as described in service agreements
Limitations of Liability
To the maximum extent permitted by law, Infolyxo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.
Service Limitations
We coordinate preparation services but do not directly perform most preparation work. We are not liable for the performance of third-party service providers, though we make reasonable efforts to engage qualified providers.
Property Condition and Warranties
We make no warranties regarding the condition of your property after preparation or its suitability for short-term rental operations. Property preparation does not guarantee rental success, occupancy rates, or revenue generation.
Regulatory Compliance
You are responsible for ensuring your property and rental operations comply with all applicable laws, regulations, and permit requirements. We provide preparation services but do not provide legal advice or regulatory compliance verification.
Intellectual Property
Photography and listing content created during property preparation are provided for your use in marketing your property for short-term rental. You may use these materials for that purpose but may not sell, license, or otherwise commercialize them separately.
Confidentiality
We maintain confidentiality of information about your property and preparation project. We may use anonymized project information for business purposes such as service improvement or marketing, but will not disclose identifying information without your consent.
Termination
Either party may terminate a service engagement according to terms specified in the applicable service agreement. Termination does not relieve either party of obligations incurred prior to termination.
Dispute Resolution
Any disputes arising from these Terms or our services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through arbitration in Arica, Chile, in accordance with Chilean arbitration procedures.
Governing Law
These Terms are governed by the laws of Chile. Any legal proceedings related to these Terms or our services shall be brought in the courts of Arica, Chile.
Changes to Terms
We may modify these Terms from time to time. If we make material changes, we will notify you by email or through our website. Continued use of our services after changes constitutes acceptance of modified Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
Entire Agreement
These Terms, together with any applicable service agreement, constitute the entire agreement between you and Infolyxo regarding our services and supersede all prior agreements and understandings.
